This Application collects some Personal Data from its Users. This document can be printed for reference by using the print command in the settings of any browser.

PopGrinder Terms and Conditions for "PopGrinder PRO"

1. Introduction

PopGrinder is an application that allows users to track and manage their collections efficiently. The "PopGrinder PRO" subscription service offers premium features to enhance the user experience. By accessing or using the PopGrinder Pro service, you agree to comply with and be bound by these Terms and Conditions.

2. Pro Features

  • 2.1 More Folders: Pro users can enjoy up to 60 folders.
  • 2.2 Unlimited Items in Folders: Pro users can add an unlimited number of items within each folder.
  • 2.3 Unlimited Custom items: Pro users can add an unlimited number of custom items.
  • 2.4 Export Folder into CSV file: Pro users can export their folders into a CSV file.
  • 2.5 30 Crowns/month or 300 Crowns/year to unlock all features. (not included in free trial and promo codes)
  • 2.6 Banner Removal: Pro users will not see banners within the App.
  • 2.7 20% bonus Crowns on every purchase.
  • 2.8 AI Poster from Folder Top Funkos: Pro users can generate AI posters based on top items in a folder.
  • 2.9 Pro Themes: Pro users can unlock and use premium themes.
  • 2.10 AI Shop Discount: Eligible Pro subscribers receive 20% off all AI Funkify Shop products at checkout while the subscription is active.

3. Image Management

  • 3.1 Image Upload and Storage: Images are stored on our servers only when voluntarily uploaded by users to create or manage Custom Items in the App. While we strive to protect your privacy, we cannot guarantee absolute security of uploaded images.
  • 3.2 Image Content: You are responsible for the content of the images you upload. You agree not to upload images that violate the rights of others, contain illegal, offensive, or inappropriate content. We reserve the right to remove any image that we believe violates these Terms or applicable laws.
  • 3.3 Image Usage: We use uploaded images only to provide the specific feature requested by the user. In particular, images uploaded for Custom Items may be stored and displayed for that purpose, while images uploaded for the Image Generation Service (“Crowns”) and AI Funkify Shop are never reused for database improvement, machine learning, or other secondary purposes and are processed solely to generate the requested image or merchandise preview, in accordance with Section 5.
  • 3.4 Image Disclaimer – Items and Stickers: All item images, sticker images, previews, and visual representations displayed within the App are provided for reference purposes only. Such images may be user-submitted, community-reported, AI-generated, edited, or sourced from third-party references and are not guaranteed to be official materials released or approved by Funko and/or other brands or rights holders. As a result, images and stickers shown in the App may differ from the original product in terms of colors, finish, shape, proportions, lighting, packaging details, or visual appearance. PopGrinder does not guarantee that the images displayed accurately or perfectly represent the official physical product sold or distributed by the relevant brand or retailer and shall not be held responsible for any discrepancies between the images shown in the App and the actual item owned, purchased, or received by the user.

4. Subscription Fees and Payment

  • 4.1 Pricing: The PopGrinder Pro subscription is available for $2.99 per month or $29.99 per year (the price may vary based on location and offers and promotions).
  • 4.2 Payment Processing: Payments for the Pro subscription are managed through the respective app stores (Apple App Store and Google Play Store) and through RevenueCat, which ensures secure and seamless payment processing.
  • 4.3 Automatic Renewal: The Pro subscription automatically renews each month or year unless cancelled by the user through the app store's subscription management settings.
  • 4.4 Cancellation: You may cancel your Pro subscription at any time through your app store account. Your access to Pro features will remain active until the end of the current billing cycle.
  • 4.5 Refunds: Subscription fees are non-refundable. If you cancel your Pro subscription, you will not receive a refund for any unused portion of the subscription period.

5. Image Generation and AI Shop Service (“Crowns”)

PopGrinder offers features that allow users to generate stylized avatar images, AI posters, and AI Funkify Shop designs inspired by Funko-style collectibles and/or other brands using photos they upload and folder data. These services are accessed via virtual credits called “Crowns”, which can be purchased in-app or granted through a PopGrinder Pro subscription. Certain generated images may also be used to create print-on-demand products derived from that specific design.

5.1 How It Works

  • The uploaded photo is sent to OpenAI’s image generation API for transformation.
  • Photos uploaded for image generation are never reused, analyzed, shared, or retained for database improvement, machine learning, Custom Item creation, or any other purpose beyond the single requested transformation.
  • PopGrinder does not retain or store the original photo beyond processing, and the original photo is deleted after the transformation process is completed, within the time strictly necessary to provide the service.
  • The generated image is stored temporarily on our servers (hosted on AWS) for 7 days, during which the user may download the image via the app.
  • After 7 days, the image is permanently deleted and cannot be recovered.

5.2 AI Shop Orders and Fulfillment

  • AI Funkify Shop allows users to apply generated artwork to merchandise such as tees, hoodies, stickers, posters, frames, bags, and other products made available in the App from time to time.
  • These items are print-on-demand products generated from a specific user-selected image or design. Each image may produce its own unique set of purchasable products and previews.
  • Order checkout is processed through third-party commerce partners, including Shopify infrastructure, and may require storing product selections, invoice metadata, and order status information.
  • AI shop products are custom-made. Production times, tracking updates, and delivery windows may vary depending on the product and destination.
  • PopGrinder may display order history and tracking links inside the App to help users review purchases and shipping progress.
  • Eligible PopGrinder Pro subscribers may receive a 20% discount on AI shop products at checkout while their subscription remains active.

5.3 Returns and Refunds for AI Shop Products

  • Because AI shop items are print-on-demand and custom-made from unique user-generated designs, returns or exchanges for change of mind are generally not available.
  • Once production has started, cancellation, reversal, or refund requests may be rejected unless required by law or covered by the exceptions below.
  • If a product arrives damaged, defective, or incorrect, users should contact support with order details and relevant photos so the issue can be reviewed.
  • Approved replacements or refunds, when applicable, are handled according to the terms of the relevant commerce and payment providers.

5.4 Ownership and Use

  • All uploaded photos and generated images remain the property of the user.
  • PopGrinder acts solely as a service provider and does not claim any rights over the images.
  • The generated image is intended for personal use only and may not be used for resale, commercial exploitation, or reproduction of intellectual property protected characters.

5.5 Payment and Refunds

  • Crowns are managed via RevenueCat, and payments are processed through the user’s respective app store (Apple or Google).
  • Refunds, where applicable, are subject to the terms of the relevant app store. PopGrinder does not manage or issue direct refunds for Crown purchases.

5.6 Third Parties Involved

  • OpenAI: processes the image for transformation.
  • Shopify and related checkout partners: process invoice, checkout, and order metadata for AI shop purchases.

6. Pricing Systems and Ongoing Migration

  • 6.1 PopGrinder continuously improves its pricing systems, AI models, and supporting infrastructure to enhance price quality, variant matching, and marketplace filtering.
  • 6.2 These improvements may be deployed gradually across the catalog and supporting services. As a result, some items may receive updated pricing behavior, confidence levels, or refresh timing before others.
  • 6.3 PopGrinder does not guarantee that every item will be migrated to a new pricing pipeline at the same time or that intermediate values will remain unchanged during rollout periods.

7. User Responsibilities

  • 7.1 Accurate Information: You agree to provide accurate and up-to-date information during the subscription process.
  • 7.2 Compliance: You agree to use the PopGrinder Pro service in compliance with applicable laws and these Terms.
  • 7.3 Account Security: You are responsible for maintaining the security of your account credentials and any activities that occur under your account.

8. Termination and Suspension

  • 8.1 Termination by User: You may terminate your PopGrinder Pro subscription at any time through your app store account settings.
  • 8.2 Termination by PopGrinder: We reserve the right to terminate or suspend your Pro subscription if we believe you have violated these Terms or engaged in any illegal or inappropriate conduct.

9. Limitations and Liability

  • 9.1 No Warranty: PopGrinder Pro is provided "as is" and "as available." We do not guarantee that the service will be error-free, uninterrupted, or that it will meet your specific needs.
  • 9.2 Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from the use of PopGrinder Pro.

10. Changes to the Terms

  • 10.1 We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or via email.
  • 10.2 Your continued use of the PopGrinder Pro service after such changes constitutes your acceptance of the revised Terms.

11. Governing Law

  • 11.1 These Terms are governed by and construed in accordance with the laws of the jurisdiction in which PopGrinder operates.
  • 11.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Miscellaneous

  • 13.1 Entire Agreement: These Terms constitute the entire agreement between you and PopGrinder regarding your use of the PopGrinder Pro subscription.
  • 13.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • 13.3 Waiver: The failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
